Jimmy Manyi, the outspoken President of the Progressive Professionals Forum, calls for the Preferential Procurement Policy Framework to be replaced by broad-based economic empowerment (B-BBEE) trumping clause.
Manyi, whose candid views on matters transformation have ruffled a few feathers in the private sector, feels the preferential procurement places more emphasis on price than black empowerment.
“Preferential Procurement it out of sync with the generic codes,” he says, expressing concern that the BEE Commission has not been given mandate to deal with this matter.
Some businesses find the trumpling clause difficult to interpret. However, in a nutshell, it states: “The BEE act will take precedence over any other law that was in force prior to the date of the commencement of the act. Specifically, this relates to all other instruments of BEE, such as codes of good practice and sectoral charters.”
